These Terms of Service ("Terms") govern your use of the ivrhost.com website and of the phone, IVR, voice notification and text messaging services provided by CYG Group Inc. ("CYG Group", "we", "us"). By using our website or services, you agree to these Terms.

1. Our services

CYG Group provides software development and telecommunications services, including phone systems, IVR call flows, information hotlines, voice notifications, SMS messaging, payment and donation lines, and related hosting and support. Services for clients are provided under the terms agreed with each client. Where those terms conflict with these Terms, the client agreement controls.

2. Text messaging program terms

• Program: CYG Group Inc. and the programs we operate send informational text messages such as alerts, reminders, confirmations and account notices to people who have opted in.
• Consent: by opting in, you agree to receive recurring text messages from the program you subscribed to at the number you provided. Consent is not a condition of any purchase.
• Frequency: message frequency varies.
• Cost: message and data rates may apply, according to your mobile plan.
• Opt-out: reply STOP at any time to cancel. You will receive one confirmation message and no further messages. Reply START to resubscribe.
• Help: reply HELP for help, or contact us at (718) 344-7468 or bracha@ivrhost.com.
• Carriers: carriers are not liable for delayed or undelivered messages.
• Privacy: see our Privacy Policy. Mobile opt-in data and consent are never shared with third parties.

3. Voice calls and notifications

If you subscribe to voice notifications, you agree to receive automated or prerecorded calls from the program you subscribed to at the number you provided. You may opt out at any time using the option provided on the call, or by contacting us.

4. Acceptable use

You agree not to use our services or systems to:

• send calls or messages to anyone who has not given the required consent, or who has opted out;
• send unlawful, deceptive, fraudulent, harassing, threatening or abusive communications;
• misrepresent your identity or display false caller ID information;
• violate the TCPA, the Telemarketing Sales Rule, Do Not Call rules, carrier policies or any other applicable law; or
• interfere with or attempt to gain unauthorized access to our systems.

We may suspend or terminate service that violates these Terms or our Communications Compliance Policy.

5. Client responsibilities

Clients who use a system we build or operate are responsible for the content of their communications, for obtaining and keeping valid consent from the people they contact, and for honoring opt-out requests, in line with our Communications Compliance Policy.

6. Third-party services

Our services rely on third-party carriers, messaging providers, payment processors and hosting providers. Their availability is outside our full control, and their own terms may also apply.

7. Intellectual property

The content of this website and our software remain the property of CYG Group Inc. or its licensors, except as otherwise agreed in writing with a client.

8. Disclaimer and limitation of liability

Our website and services are provided "as is" and "as available". To the fullest extent permitted by law, CYG Group Inc. disclaims all implied warranties and is not liable for any indirect, incidental, special or consequential damages arising from the use of the website or services.

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.

10. Changes

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Continued use of the website or services after a change means you accept the updated Terms.
